Pilot examination and registration of drone operators

Pilots of unmanned aircraft or drones whose mass is 250g or more, shall be subjected to theoretical examination online, and drone operators shall be registered at the web page of the Civil Aviation Agency (CAA). That is an obligation enacted pursuant to the application of the new Regulation on conditions for operating unmanned aircraft systems and model aircraft.

Registration of drone operators at the Agency is necessary – both new and already registered ones because it is required to complement the data. In accordance with old rules, more than 2000 operators are registered from 2016 until now.

After submitting appropriately filled in registration forms, the CAA shall issue statement with given registration number. We hereby emphasize it is required to have the appropriate documents in order to avoid prolonged duration of this process.

New obligations free of charge

Taking examination for pilots and operator registration is free of charge.

In accordance with the new rules, operators using unmanned aircraft whose mass is 250g or more, as well as mass up to 250g if equipped with sensors for collecting personal data such as camera, microphone, etc. are obliged to register.

After registration, each operator shall be provided with digital (electronic) registration number, with secret code. Only one e-ID shall be given to natural person or legal entity in order to enable unique identification. All drones owned by that person shall be marked by this number.

Registration number shall be valid for two years, after which it must be renewed following the same procedure.

 

Rules for foreign citizens

 

Foreign citizens, who are already registered and who passed theoretical examination in the European Union (EU) Member State don’t have those obligations in Montenegro, but they shall submit evidence on passed examination and statement on registration or registration number.

Likewise, also foreign citizens must have liability insurance policy against damage caused to third parties that covers the territory of Montenegro or the EU. As regards import, the procedure remains as is – obtaining approvals for import/export with the Ministry of Economic Development.

New regulation, containing the European regulation, became applicable in July this year. It lays down conditions for safe use of unmanned aircraft systems in Montenegro, as well as conditions that must be met by personnel, including drone pilots and organisations involved in conducting of these operations.

Each natural person and legal entity registered as unmanned aircraft operator can operate drone.

We hereby remind you that the new Regulation provides for operations divided in three categories (open, special and certified), where the open category is the one with the smallest level of risk.

Limitation for age of pilot in Montenegro is 16 years of age, in case of pilots from Montenegro and from other countries as well, including the EU Member States.

All operators must have liability insurance contract against damage caused to third parties by using unmanned aircraft, in accordance with the Law on Compulsory Traffic Insurance of Montenegro.

Operators must pay particular attention to operations in the vicinity of Tivat airport and Podgorica airport (CTR zone), where it shall be necessary to obtain approval of competent air traffic control, namely the Airspace Management Cell – AMC Montenegro.

Drones must not fly above assemblies of people (in open category), above persons uninvolved in operations (except in case of drones whose mass is less than 250g), nor in controlled airspace without approval of AMC Montenegro, etc.

Penalty fines are laid down by the Law on Air Transport in the amount from 500 to 2000 EUR.

It is also necessary that unmanned aircraft operator/pilot ensures protection of privacy of people. Criminal code of Montenegro defines penalty provisions for unauthorised taking of photo, publishing and presenting other persons’ acts, portraits and records.
